Selling a house in undivided co-ownership in Corsica

Until the estate is divided, the property belongs to all the heirs in undivided co-ownership. Selling therefore means securing their agreement — or using the legal routes available when unanimous agreement is impossible.

Who needs to give their consent?

Selling jointly owned property generally requires the unanimous consent of the co-owners. Since the law of 12 May 2009, however, co-owners holding at least two thirds of the ownership rights can ask the court for permission to sell, after formally notifying the others. The judge assesses whether the sale would disproportionately prejudice the rights of those opposing it.

The role of the notary and the agency

The notary settles the estate, prepares the property ownership certificate and drafts the deed. The agency's role is to establish a sound valuation: a well-supported valuation accepted by all heirs defuses most disputes. In Corsica, old title deeds and properties without defined boundaries make this stage even more crucial.

    Frequently asked questions

Can a single heir block the sale?

Yes in principle, as unanimity is required. However, co-owners representing at least two thirds of the ownership rights can apply to the tribunal judiciaire, the civil court, for authorisation to sell. The procedure goes through the notary, who formally notifies those opposing the sale of the proposal.

How long does it take to sell a property in undivided co-ownership?

Allow for the estate settlement period (often 6 to 9 months), then the marketing period. Where the property inheritance certificate has already been registered and the heirs agree, the sale follows a standard timeframe of 3 to 4 months.

How are the sale proceeds divided?

The notary distributes the net sale proceeds in proportion to each person's entitlement, after settling costs, estate debts and any outstanding tax. One heir can also buy out the others' shares: this is known as a rachat de soulte.
